1. Working The customer shall give access within all Able Plumbing Maintenance Limited usual working hours. In the event if this being given and overtime worked at the customer’s request. The extra cost will be chargeable in the addition to the quoted price. 2. Programme of work Every effort will be made to meet the requirement of the Customer, but no guarantee can be given for the commencement or the completion of the work. Able Plumbing Maintenance Limited accept no responsibility for the delay in execution of the work or damage or inconvenience caused, due to labour disputes, fire, accident, non delivery or shortage of materials or any other causes beyond Able Plumbing Maintenance Limited control. 3. Making good etc Whilst every care will be taken by Able Plumbing Maintenance Limited it accepts no responsibility for any damage to plaster work, wood work, decoration, flooding etc necessarily consequent upon the execution of the work unless specially provided for in this quotation. Cuts or holes made to allow for materials or equipment will be made good but not permanently finished or decorated floor boards will be replaced but special flooring permanently fixed will not be taken up or replaced by us. 4. Way leaves The Customer shall be responsible for obtaining and retaining any necessary consents casements or way leaves and for the reinstallment of any disturbed ground in the case of extensions to any underground distributing lines which are within the customers own property or on privately owned, over which the Customer has rights of access or tenancy. 5. Licences Any licence, permit or other necessary for the execution of the work shall be obtained by the Customer. 6. Guarantee Subject as mentioned Able Plumbing Maintenance Limited guarantees all equipment installation or apparatus supplied and fixed under the quotation for a period of three month from the date of completion of the work, and undertakes to repair or replace the same at its option. In the event of them becoming defective and/or to remedy any defect found to be due to faulty workmanship within that period, free of cost unless otherwise specified in this quotation. Able Plumbing Maintenance Limited guarantee does not cover defects due to fair wear and tear, the replacement of lamps or fuses, or any cause beyond the control of Able Plumbing Maintenance Limited. Able Pumbing Maintenance Limited should be given a fair chance to rectify any faults or workmanship that may occur during the guarantee period. No compensation or refund will be given unless the above is adhered to. If any repairs, alterations or additions to any equipment or installation, and/or apparatus are carried out by any person who has not been specifically authorised by Able Plumbing Maintenance Limited the guarantee will be null and void. There can be no guarantee for any blockage work carried out, whether this is from a toilet, basin or drain. 7. Fluctuations Invoices are strictly net and the quoted price will be adjusted to meet any price variations in labour or materials occurring the date of quotation. 8. Term of Payment Payment shall become due on demand unless previously agreed otherwise, Failure to pay will incur an interest charge of 10% per month. Progress payments ( if applied for) are not less than fortnight intervals for the total value of the work done and/or materials delivered to the site or to Able Plumbing Maintenance Limited stores, shall be made within 14 days of the application. In the event of a progress payment not being made in full within the time frame mentioned above, Able Plumbing Maintenance Limited shall have the right to stop work or to Able Plumbing Maintenance Limited stores shall be made within 14 days of the application. In the event of a progress payment not being made in full within the time frame mentioned above, Able Plumbing Maintenance Limited shall have the right to stop work forthwith and shall, at its option be entitled to treat the contract as repudiated by the Customer, and to charge the Customer for the work done and materials supplied on a quantum merit basis. It is without prejudice to Able Plumbing Maintenance Limited right to claim damages for the work. However if Able Plumbing Maintenance Limited elect to resume work upon such payment being made, the expense incurred by such stoppage and the subsequent resumption of work shall be chargeable to the Customer in addition to the quoted price. 9. Extra cost In the event of suspension or cancellation of work at the request of the Customer, or lack of instructions or delay on site, caused by matters beyond the control of Able Plumbing Maintenance Limited any extra expense thereby incurred shall be chargeable to the Customer. If overtime is worked or alterations are made at the request of the Customer, the extra cost incurred including a reasonable addition for administration expenses and overheads charges will be met by the Customer. 10. Provisional sum, variations and additions to contract Charges for work carried out by Able Plumbing Maintenance Limited include provisional sums and variations to the contract shall be invoiced at standard day work rates for contract additions in accordance with the quotation or as otherwise agreed beforehand. 11. Position of Lighting Points, Switches, Plant etc If not provided for in the quotation or an associated drawing are to be determined before work is commenced, and any change required therein shall be notified by the Customer to Able Plumbing Maintenance Limited in writing in sufficient time not to impede the progress of the work. Any extra work necessary to meet such changes will be chargeable to the Customer in addition to the quoted price. 12. Consequential Loss or Damage Able Plumbing Maintenance Limited shall not be responsible for any consequential damage or loss arising out of the performance of the contract, otherwise then by the negligence of Able Pumbing Maintenance Limited or its employees or its agents. 13. Damage in Transit Where the price quoted includes. Able Plumbing Maintenance Limited will repair or replace, free of charge, goods damaged in transit provided the carriers and Able Plumbing Maintenance Limited receive notification of such damage within 3 days of delivery and that such notification is confirmed in writing within 7 days, but not otherwise. 14. Scope of Conditions of Contracts These conditions will apply in full to all quotations and work carried out (and) or apparatus or equipment supplied by Able Plumbing Maintenance Limited under such quotations except where specially agreed in writing to the contrary. 15. Taxation The price quoted is subject to any subsequent variation in taxation. |
